Please read these Terms of Service ("Terms") carefully before using Win Worthy (the "Service"), a bid/no-bid decision scoring tool for sales professionals, operated by Win Worthy ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.
By creating an account, accessing, or using the Service in any way, you agree to be bound by these Terms and our Privacy Policy. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms. If you do not agree to these Terms, you may not use the Service.
You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement.
Win Worthy is a web-based SaaS application that helps sales and business development professionals evaluate sales opportunities using a structured scoring framework. The Service enables users to score opportunities across multiple criteria, receive Go/Caution/No-Go recommendations, track assessment history, and export results.
The recommendations and scores generated by the Service are informational tools to assist your decision-making process and do not constitute professional business, financial, or legal advice. All business decisions remain your sole responsibility.
To use the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account credentials and for any activity that occurs under your account.
You must notify us immediately at support@winworthy.com of any unauthorized use of your account. We will not be liable for any loss or damage arising from unauthorized use of your credentials. You may not share your account with others or use another person's account without permission.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

The Service is offered under the following subscription plans:
All plans include a 14-day free trial. No credit card is required to start your trial. After the trial period, you will be required to provide a valid payment method to continue using the Service. Subscription fees are billed in advance on a monthly basis.
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods. We reserve the right to change pricing at any time with 30 days' notice to active subscribers.
Payment processing is handled by Stripe. By providing payment information, you agree to Stripe's terms of service. We do not store your payment card details on our servers.
The Service and all content, features, and functionality thereof — including but not limited to the scoring framework, algorithms, user interface, text, graphics, and software — are owned by Win Worthy and are protected by intellectual property laws. These Terms do not grant you any right, title, or interest in the Service beyond the limited license to use the Service as described herein.
You retain ownership of any data you input into the Service ("User Content"). By using the Service, you grant us a limited, non-exclusive, royalty-free license to store and process your User Content solely for the purpose of providing the Service to you. We do not use your User Content to train machine learning models or share it with third parties except as described in our Privacy Policy.
Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our data practices as described in the Privacy Policy.
We employ industry-standard security measures to protect your data, including encrypted connections (HTTPS) and secure cloud infrastructure. However, no method of transmission over the Internet is 100% secure, and we cannot guarantee absolute security.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
We do not warrant that any scoring outputs, recommendations, or results obtained through the Service will be accurate, reliable, or meet your requirements. Your use of the Service and reliance on any output is at your own risk.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WIN WORTHY, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE MONTHS PRIOR TO THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).
You may terminate your account at any time by using the account deletion feature in your account settings or by contacting us at support@winworthy.com. Upon termination, your right to use the Service will immediately cease.
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. We will make reasonable efforts to notify you in advance of termination unless your use constitutes a material breach of these Terms. Upon termination, we may delete your account data after a 30-day grace period.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a new "Last updated" date and, where required by applicable law, by sending an email to the address associated with your account. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.
We encourage you to review these Terms periodically. If you do not agree to the modified Terms, you should discontinue your use of the Service.
